Auction conditions

Sales are awarded to the highest bidder after being called three times and paid in cash (CHF) or over wire transfer.
  1. The knockdown will be made after three calls to the highest bidder against immediate cash payment in Swiss currency. Due to our strict settlement regulations vis-à-vis the consignors, the auction invoices must be settled no later than 10 days after the auction date. Late payments will be subject to a default interest of 12% p.a.
  2. All objects are auctioned in the name and on behalf of third parties. Each buyer is personally liable for the bids he or she has made orally or in writing and cannot claim to have bought on behalf of third parties. The auctioneer may require a bidder unknown to him to prove his identity. 
  3. A premium of 24% (including VAT) is payable on the hammer price. 
  4. Swiss VAT of 7.7% is payable on the hammer price. Buyers domiciled abroad who provide an export declaration duly stamped by Swiss customs will be refunded VAT if the amount exceeds CHF 30. 
  5. If payment is not made on time, the buyer can insist on fulfilment of the purchase contract and compensation for damages caused by delay. Instead of this, the auctioneer may also join the auctioned items in a subsequent auction without limitation or sell them at best by private contract. In such cases, the debtor must pay, in addition to the premium in accordance with Section 3 of these conditions and the difference between the hammer price and any lower proceeds, an additional 20% of the hammer price for the auctioneer's activities. The debtor has no claim to any additional proceeds. 
  6. The auctioneer reserves the right to combine or separate individual items in the catalogue, to offer them out of sequence or not to put them up for auction. Offers, calls and knockdowns below any limits are permitted.
  7. The objects will be auctioned in the condition in which they are at the moment of acceptance of the bid. With successful acceptance of the bid, the benefit and risk of the objects are transferred to the buyer. Every interested party has the opportunity to personally inspect the condition of the objects at the exhibition preceding the auction. The description of the objects in this catalogue has the character of an expression of opinion only and, unless otherwise noted, does not constitute a guarantee of any characteristics. The auctioneer is not liable for incorrect attributions or incorrect statements regarding origin, date, age, provenance, condition or authenticity, nor for other open or hidden defects. With the exception of the following provisions, any warranty of the auctioneer is excluded. 
  8. If, within 60 days of the auction sale, a buyer provides the auctioneer with written proof, based on a recognised expert opinion, that an object is a forgery contrary to the description in the catalogue, the auctioneer will cancel the purchase and refund the purchase price on condition that the object is returned within 14 days of this notification in the same condition in which it was found at the time of the knockdown. 
  9. The Stadtammannamt Zürich 1 will participate in the auction. The auctioneer is responsible for organising, directing, calling, knockdown, recording, collecting the proceeds, surrendering the property and settling accounts with the clients, subject to the right to resolve disputes. Neither the Mayor of Zurich, his representative, nor the city or canton of Zurich are liable for his actions.
  10. Benefit and risk are transferred to the auctioneer with the acceptance of the bid. However, the right of disposal and handover is subject to full payment of the hammer price and the premium. The objects can be collected during the auction and at the latest 30 days after the auction date after prior telephone registration at the offices of the Auction House. For objects that have not been collected 10 days after this date, the auctioneer is entitled to have them stored at the buyer's expense and risk. The Auction House is happy to organise transport of the auctioned items at the expense of the buyer. 
  11. As place of performance and exclusive place of jurisdiction the buyer acknowledges the domicile of the Auction House Zurich 1. 
  12. With every bid placed, whether verbally or in writing, the auctioneer accepts the above-mentioned auction conditions.
